What is an Australian Spouse Visa?

An Australian spouse visa allows the spouses or de facto partners of Australian citizens and permanent residents to join their partners living in Australia as permanent residents. Aspirants can apply for spouse visas or partner category visas if they are,

  • Spouse of an Australian citizen, permanent resident or eligible New Zealand citizen, or
  • Fiancé of an Australian citizen, permanent resident or eligible New Zealand citizen, or
  • De facto partner with an Australian citizen, permanent resident, or eligible New Zealand citizen

Types of Australia Partner of Spouse Visas

  • Permanent Partner Visa (Subclass 801): This is a permanent visa. Applicants can apply for this visa at least two years after they are granted the Subclass 820 temporary partner visa.
  • Prospective Marriage Visa (Subclass 300) or the Fiancé Visa: This is a non-immigrant temporary visa. It allows you to stay in Australia for nine months, marry your partner in Australia and then upgrade to a temporary partner visa, Subclass 820 visa.

How to Apply for an Australian Spouse Visa?

Here’s how the procedure for an Australian spouse visa works.

  • You must apply for a temporary and permanent visa by filling out an application and submitting it to the right bodies for assessment.
  • After the form examination, if you meet the criteria for this Australian visa, the offices may give you a temporary Partner Visa.
  • This visa is valid until you receive your permanent visa, usually given two years after the application is lodged.
  • If you meet all the criteria, even after two years, you get a permanent partner visa.

But you may get a permanent visa without waiting for the stipulated period if you produce evidence that you and your partner have been married or in a relationship for three years or more.

Besides, you may get a permanent visa if you and your partner have been involved or married for more than two years and a child (dependent) from you and your partner is present.
